Cluttered Houses

Can you sell a house full of belongings, or a hoarded house, in Florida?

Yes. A Florida house can be sold with the contents still inside, whether it is a parent's estate, a long-term rental left behind or a hoarded home. Here is what you need to decide before a buyer walks through.

The short answer

Yes. A house does not have to be emptied to be sold, and some buyers take the house with its contents so the owner does not have to clear it. What matters is who owns what is inside, and whether anything of value, anything personal or anything hazardous has to be dealt with first.

Howler Property Group LLC, a Tampa-based company that buys Florida houses directly, publishes this guide. It is general information, not legal advice.

Who owns what is inside the house?

  • You are the owner. The contents are yours. Decide what to keep, then agree in the contract what happens to the rest.
  • The owner has died. Their belongings are part of the estate, and the personal representative decides what happens to them. Heirs should not carry out or throw away valuables, papers or anything the will mentions before that person is appointed. See selling a house in probate.
  • A tenant left things behind. Florida has a set process for abandoned tenant property under Chapter 83, and it starts with written notice. Check it before you remove anything. See also selling a tenant-occupied house.

What should you pull out before a buyer comes?

  • Cash, jewelry, firearms, medications and important papers such as deeds, wills, insurance policies, tax records and photographs
  • Anything with a name or an account number on it that you do not want to leave behind
  • Anything of sentimental value to the family

Photograph each room first. Photographs help a buyer understand the house, and they help an estate show what was there.

What about a hoarded house or one with a safety problem?

Tell the buyer plainly. Heavy clutter can hide roof leaks, mold, pests or damaged floors, and a seller who knows about a serious problem the buyer cannot easily see has to disclose it, even in an as-is sale. The rules are in what selling as-is means in Florida.

Clutter and overgrowth can also lead to code enforcement action. Fines that go unpaid can be recorded as a lien, which is paid from the sale proceeds. See code violation liens in Florida.

Do you have to clean out the house before closing?

Not always. The contract says what condition the house is delivered in. Some buyers accept it with contents inside, some ask for it broom-clean, and the terms can be written either way. If the house has to be cleared, a clean-out crew can usually be scheduled around the closing date.

Where does Howler Property Group fit in?

Howler Property Group buys Florida houses as-is for cash, including houses full of belongings, with no clean-out and no staging. Tell us what is inside, and we explain how that affects the terms. See also selling a house in any condition.

Frequently asked

Can I sell a Florida house with everything still inside?
Yes. Some buyers will take a house with its contents, and the contract states what is included and what condition the house is delivered in.
Who owns the belongings in a house after the owner dies in Florida?
They are part of the estate, and the personal representative decides what happens to them. Heirs should wait for that appointment before throwing away or giving away valuables.
Can I throw away a tenant's belongings after they leave in Florida?
Not right away. Chapter 83 of the Florida Statutes sets a process for abandoned tenant property that starts with written notice, so check it before removing anything.
Do I have to disclose a hoarding problem when I sell a house in Florida?
Florida case law generally expects a seller to disclose known serious defects a buyer would not easily see, such as leaks, mold, pests or damaged floors that clutter may hide. An as-is clause does not remove that duty.
Can I sell a house with code violations from clutter or overgrowth?
Yes. Unpaid code fines can be recorded as a lien, and the lien is normally paid from the sale proceeds at closing.
Do I need a clean-out company before selling?
Not necessarily. The contract can provide for the house to be sold with its contents, and if it must be cleared, the clearing can be arranged around the closing date.
