Title Problems

Can you sell a Florida house with title problems, like missing heirs or a name not on the deed?

Often yes, but the title has to be cleared first. Which fix applies depends on the problem: a missing heir, an old lien, a deed error or a name that was never added.

The short answer

Often yes. A title problem does not make a house unsellable, but a buyer and a title company will not close until the problem is cleared or insured over. A title search finds what is recorded against the property. What it cannot find is what was never recorded, like a family agreement or a death that was never taken to probate.

Howler Property Group LLC, a Tampa-based company that buys Florida houses directly, publishes this guide. It is general information and not legal advice.

What counts as a title problem?

  • An owner who died with no probate opened. The deed still shows the deceased owner. See selling a house in probate in Florida.
  • Missing or unknown heirs. If there is no will, Florida law decides who inherits, and every heir may have to join the sale or be dealt with by the court.
  • A name on the deed that is wrong or a name that was never added, such as a spouse, a former spouse or a relative who helped pay.
  • Old recorded liens or judgments that were never released after being paid. See selling a house with liens.
  • Errors in an old deed, such as a misspelled name, a wrong legal description or a missing signature or witness.

How does each kind get fixed?

  • Release of lien. A paid lien is cleared by getting the creditor to record a satisfaction. The title company can often request it.
  • Probate. A deceased owner's house generally moves through the estate, and the personal representative signs.
  • Corrective deed or affidavit. Some deed errors can be fixed by a recorded correction signed by the people involved.
  • Quiet title action. When a claim cannot be cleared by agreement, a court case asks a judge to rule who owns the property. It takes time and an attorney.

A quitclaim deed passes whatever interest the signer has, with no promise that the title is good. It can help move a family member's share, but it does not cure a defect by itself, and a title company will still check everything behind it.

What if the problem is a family disagreement?

When several relatives co-own an inherited house and one will not sign, the sale cannot close without that person or a court order. A Florida attorney can explain whether a partition action is available. We do not take sides in a family dispute, and we will say so if the case needs a court before any buyer can act.

Where does Howler Property Group fit in?

Howler Property Group buys Florida houses as-is for cash and works with a title company that finds the problem before closing, not after. If the title can be cleared, we put the terms in a written contract and close when it is clear. If it cannot be cleared yet, we say so up front.

A court case that asks a judge to decide who owns a property when a claim cannot be cleared by agreement. It takes time and a Florida attorney.

What if an heir will not sign the sale papers?
The sale generally cannot close without that heir or a court order. A Florida attorney can explain whether a partition action is available.
How do I find out if my house has a title problem?
