The short answer

If a Polk County house belonged to someone who has died, the probate paperwork may already be on the public record. Between Jul 13, 2026 and Oct 26, 2026, our database captured 1,750 probate documents recorded in the Polk County Official Records, and 440 of them are dated in the last 30 days. They are documents, such as wills, letters and orders, so one estate can account for several.

These are our records, not the clerk's official count. Our Polk collector started on Jul 13, 2026, so earlier months are not in this number.

What the Polk record looks like

Polk's Official Records index labels every one of these entries PROBATE DOCUMENTS, with the decedent's name followed by 'IN RE PROBATE' and sometimes 'EST DECD', meaning the estate of a deceased person. The index carries a legal description for the property in only some entries. That is why just 519 of the 1,750 (30%) resolve to a street address. Where they do, the places named are Lakeland (201), Winter Haven (79), Davenport (38), Lake Wales (36), Bartow (26), Poinciana (26), Auburndale (24), Mulberry (23).

The days of the week are a small tell about how the paperwork arrives. Of the dated Polk documents, 417 were recorded on a Monday, 285 on a Tuesday, 330 on a Wednesday, 362 on a Thursday and 280 on a Friday, and still 63 on a Saturday and 13 on a Sunday, which suggests some documents are e-recorded outside office hours.

Who sells a Polk County inherited house

Polk County is in Florida's Tenth Judicial Circuit, with Highlands and Hardee counties, and the county seat is Bartow. Probate cases are filed with the Polk County Clerk of the Circuit Court. When the estate includes a house, the person who may sign the deed is the personal representative appointed by the court, and the proof is the letters of administration. The personal representative's power to sell estate real property comes from section 733.612 of the Florida Statutes. If the estate is small, summary administration under section 735.201 can be faster.

  1. Check whether a probate case exists in the Polk County Clerk's case search. A recorded will or letters means one does.
  2. Get certified copies of the letters of administration and the death certificate.
  3. Ask the Polk County Tax Collector what is owed on the parcel, and the Property Appraiser who is on the deed.
  4. Sign the sale contract as personal representative and close through a title company or attorney, with the deed recorded in Polk County.

Poinciana spans Polk and Osceola counties, so for a house there the clerk that matters is the one for the side of the county line where the parcel sits. Our statewide explanation is in selling a house in probate in Florida, and the numbers for other counties are in Florida probate filings by county.

We buy inherited Polk County houses as-is for cash, with no repairs and no clean-out, and the closing date can follow the estate's timeline. Call (813) 610-6460 or use the form.
